      They will fix the known EA888 issue of the thermostat housing/water pump under warranty. Not sure what the need for lawsuits over something they will fix without drama?

      So what's the other option? The M-M warranty act is not a self-enforcing law, and there is no federal agency tasked with enforcing it.

      The only way it becomes in enforceable is in civil court.

      My somewhat unique position is that I have a perfect factual situation for an M-M suit, and I happen to be a lawyer, so I can at least (in theory) bring suit to enforce it at a reasonable cost.

      That's how common law works. The law is shaped and enforced through subsequent Court decisions. The only way to obtain court decisions is to . . . you guessed it . . . become involved in lawsuits.

      If I have to pay for a new engine (in which case, I will go for a built Stage 3+ engine), then yes, it will go on the Amex. Way too much can go wrong not to have the good people at Amex on my side

      But I think the 99.6% liklihood here is that this is simply the well known thermometer/water pump issue with the EA888.

      No, not officially. Audi's official policy (which blatantly violates the M-M act) is that any car that is TD1ed will automatically void any warranties associated with the powertrain, without limitation. This is obviously no consistent with federal law.

      It happened to Aonarch's dad (whatever happened to Aonarch, anyway?). He had to hire a lawyer, threaten suit agains AoA, and they finally backed down and fixed the car.

      But VW and Audi's official policy is that a TD1 voids your warranty on ANYTHING, not just items directly associated with the tune. It would be kind of interesting to push this issue legally with Audi. But as stated, I don't think it will happen, because I think that they will back down quickly (assuming it's actually a thermostat/water pump issue).

      Perhaps, but as stated, Audi and VW's official policy is complete powertrain warranty denial on TD1. This violates federal law. But they appear to just settle whenever anyone pushes them with a credible lawsuit over it.

      Let's see what happens.

      What's fun about my case is it's the most extreme case possible -- these usually are the ones that actually make for lawsuits. I have a car that I didn't buy from Audi originally, that is modified heavily, that is at the VERY end of its warranty term, that was never touched or serviced by Audi, and that has (what appears to be) a known flaw with the engine. They are going to want, with every bone in the their German penny-pinching corporate body, to void the warranty. Let's see.

      Doesn't matter if it's flashed back to stock. ODIS will see that the ECU has been flashed for unofficial reasons (or something like that) and still TD1 the car.

      Eh, we don't always need to be so sue happy.

      I requested - and got - VWOA to cut me a $3,000 check this summer by just writing an articulate email.

      Different circumstances, but VWOA had zero obligation to provide compensation of any kind and I didn't need to swing my sue happy dick around to get what I wanted from a multi-billion dollar company.

      I'd rather hear the dealership played nice and just fixed the problem.

      Why doesn't the OP just buy a reliable Asian sport sedan? Bought sketch snit, got bit, now looking for somebody else to hit.

      I mean, if you keep going to food trucks with low sanitary grades and getting horrible cases of mud butt and your first thought while sitting on the toilet is, "I'll sue!", I think you're missing the true instigator in this continuing turd stream of drams.
